Terms of Sale, Licensing & Content Policy
Effective Date: May 11, 2026
These Terms govern your purchase and use of artwork and digital download products from FloArt
Creations (“we”, “us”, or “our”), including original abstract acrylic pour art and digital prints derived
from that artwork (the “Products”). By placing an order, downloading a file, or otherwise using our
Products, you (“Buyer” or “you”) agree to these Terms. If you do not agree, do not purchase or
download our Products.

1. About Our Products
FloArt Creations sells two categories of Products:
• Original Artwork. One-of-a-kind physical abstract acrylic pour paintings created by the artist.

• Digital Downloads. High-resolution digital files (e.g., JPG, PNG, PDF, or TIFF) representing
original acrylic pour artwork, intended to be printed by the Buyer or a print provider of the
Buyer’s choice.
Digital Downloads are licensed, not sold. You are purchasing a license to use the file under the terms set
out below — you are not buying the underlying artwork, copyright, or any exclusive rights to it.
2. Intellectual Property & Copyright
All artwork, images, designs, text, and digital files offered by FloArt Creations are the original creative
work of the artist and are protected by United States copyright law and international copyright treaties.
FloArt Creations retains all right, title, and interest in and to the Products, including all copyrights,
trademarks, and other intellectual property rights.
No transfer of copyright. Nothing in these Terms transfers ownership of the underlying artwork or
copyright to the Buyer. All rights not expressly granted in the applicable license are reserved.
Trademarks. “FloArt Creations” and any associated logos, names, and branding are trademarks of the
artist and may not be used without prior written permission.
3. License Grant — Personal Use License
Unless you have purchased a Commercial Use License (Section 4), every Digital Download is licensed to
you under this Personal Use License. This is a non-exclusive, non-transferable, non-sublicensable,
worldwide license, granted to a single individual or household, to:
• Download the file to devices you personally own or control.
• Print the artwork, in any size, for personal display in your own home or as a personal gift.
• Print up to a reasonable number of copies for personal, non-commercial use.
• Share an image of the printed and framed artwork on your personal social media, provided you
do not distribute the underlying digital file.
You may NOT, under the Personal Use License:
• Use the artwork for any commercial, promotional, or revenue-generating purpose.
• Resell, sublicense, lease, lend, share, or redistribute the digital file, in whole or in part, even for
free.
• Upload the file to any print-on-demand, stock image, NFT, generative AI training, or file-sharing
platform.
• Use the artwork on items for sale (mugs, t-shirts, prints, cards, packaging, etc.).
• Claim authorship or attempt to register copyright in the artwork.
4. License Grant — Commercial Use License
A separate Commercial Use License is required for any use of the Product that is not strictly personal.
Commercial Use Licenses must be purchased explicitly and are confirmed in writing (a sales receipt
referencing “Commercial License” or a signed license certificate from us).

Subject to payment of the applicable Commercial License fee, we grant you a non-exclusive, nontransferable,
non-sublicensable, worldwide license to use the licensed Digital Download for the
following commercial purposes:
• Use in your business marketing materials, website, social media, presentations, packaging, and
advertising.
• Use as decor in commercial spaces you own or lease (offices, restaurants, hotels, salons, retail
stores, etc.).
• Inclusion in print-on-demand or finished physical products you sell, up to a maximum of 500
units per design, unless an Extended Commercial License is purchased.
• Use in client deliverables (e.g., as part of an interior design, branding, or editorial project),
provided the file itself is not delivered to the client as a standalone asset.
Extended Commercial License
For unit runs above 500 copies, mass-market product lines, or use as a primary brand asset (e.g., a
recurring logo or signature design), you must purchase an Extended Commercial License. Contact
support@floartcreations.com for custom quotes.
Even with a Commercial Use License, you may NOT:
• Resell or redistribute the digital file itself, on its own or as part of a digital bundle, template, or
asset pack.
• Sublicense the artwork to third parties.
• Register the artwork (or any derivative) as a trademark.
• Use the artwork in a way that is defamatory, obscene, hateful, or that promotes illegal activity.
• Use the artwork to train, fine-tune, or otherwise develop machine learning or generative AI
models.
• Mint, list, or sell the artwork as an NFT or other blockchain-based token.
5. Prohibited Uses (All Licenses)
Regardless of which license you hold, you may not:
• Claim the artwork as your own original creation.
• Remove, alter, or obscure any copyright notice, watermark, or attribution.
• Make the file available on any public or shared server, cloud folder, torrent, or file-sharing
service.
• Use the artwork in a way that violates any applicable law or third-party rights.
6. Delivery of Digital Downloads
Digital Downloads are delivered electronically via a download link on the order confirmation page
and/or by email shortly after payment is confirmed. It is the Buyer’s responsibility to:
• Provide a valid, accessible email address.
• Download and securely back up the file within the access window indicated at checkout.

• Check spam/junk folders if the delivery email is not received.
If you do not receive your file, contact us at support@floartcreations.com within 14 days of purchase
and we will assist in restoring access.
7. Payment, Pricing & Taxes
All prices are listed in U.S. Dollars (USD) unless otherwise stated and are exclusive of any applicable sales
tax, VAT, or duties, which are the Buyer’s responsibility unless collected at checkout. We reserve the
right to change pricing at any time; the price in effect at the time of your order is the price that applies
to that order.
8. Refunds & Returns
Digital Downloads
Because Digital Downloads are delivered instantly and cannot be “returned,” all sales of Digital
Downloads are FINAL and NON-REFUNDABLE once the download link has been issued or the file has
been accessed. By completing checkout, you expressly acknowledge that you are receiving digital
content immediately and waive any statutory right of withdrawal where permitted by law.
Exceptions, considered on a case-by-case basis:
• The file is corrupted, missing, or materially different from what was advertised.
• You were charged in duplicate due to a technical error.
Claims must be submitted to support@floartcreations.com within 14 days of purchase, with order
number and details of the issue.
Original Physical Artwork
Original artwork may be returned within 14 days of delivery, unused and in original condition, with the
Buyer responsible for return shipping and insurance. Custom or commissioned pieces are nonrefundable
once production has begun.
9. Print Quality & Color Disclaimer
Colors on screen may vary from printed output due to differences in monitors, color profiles, paper
stock, ink, and print equipment. FloArt Creations is not responsible for color variation, sizing issues, or
print quality resulting from third-party print providers, home printers, or the Buyer’s choice of materials.
We recommend printing on quality matte or fine art paper with a professional print service for best
results.
10. Termination of License
Any breach of these Terms will automatically and immediately terminate the license granted to you,
without notice and without refund. Upon termination, you must:
• Cease all use of the artwork and any derivative works.
• Permanently delete all digital copies in your possession or control.

• Remove the artwork from any product, website, or material in which it appears, to the extent
commercially feasible.
Termination of a license does not limit any other rights or remedies available to us, including the right to
seek statutory damages, actual damages, injunctive relief, and recovery of attorneys’ fees.
11. Warranties & Limitation of Liability
Products are provided “AS IS” and “AS AVAILABLE,” without warranties of any kind, express or implied,
including any implied warranties of merchantability, fitness for a particular purpose, or noninfringement,
except as required by applicable law.
To the maximum extent permitted by law, FloArt Creations’s total aggregate liability arising out of or
related to your purchase or use of any Product shall not exceed the amount you paid for the specific
Product giving rise to the claim. In no event shall we be liable for any indirect, incidental, consequential,
special, exemplary, or punitive damages, including lost profits or goodwill, even if advised of the
possibility of such damages.
12. Indemnification
You agree to defend, indemnify, and hold harmless FloArt Creations, the artist, and their respective
successors and assigns from and against any claims, damages, losses, liabilities, costs, and expenses
(including reasonable attorneys’ fees) arising out of: (a) your breach of these Terms; (b) your use of any
Product outside the scope of your license; or (c) your violation of any law or third-party right.
13. Governing Law & Disputes
These Terms are governed by the laws of the State of Florida, United States, without regard to its
conflict of laws principles. The parties agree that any dispute arising under or relating to these Terms
shall be resolved exclusively in the state or federal courts located in Florida, and the parties consent to
the personal jurisdiction of such courts. The United Nations Convention on Contracts for the
International Sale of Goods does not apply to these Terms.
Each party waives any right to a jury trial and agrees that any claim must be brought on an individual
basis, not as a plaintiff or class member in any purported class or representative proceeding.
14. Changes to These Terms
We may update these Terms from time to time. The version in effect on the date of your purchase
governs that purchase. Continued use of our website or Products after an update constitutes acceptance
of the revised Terms going forward.

What personal data we collect and why we collect it
We collect personal data that you provide to us directly, data generated automatically through your interactions with our site, and transactional data created when you place an order. We collect this information so that we can operate the site, fulfill orders, communicate with you, comply with our legal obligations, and improve our products and services. Where required by law, we rely on your consent; otherwise we rely on the performance of our contract with you, our legitimate business interests, or compliance with legal obligations as the basis for processing.
Comments
When visitors leave comments on the site we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection.
An anonymized string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. The Gravatar service privacy policy is available here: https://automattic.com/privacy/. After approval of your comment, your profile picture is visible to the public in the context of your comment.
Media
If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website.
Contact forms
If you submit a contact form on our site, we collect the information you provide (such as your name, email address, and the contents of your message) so that we can respond to your inquiry. We retain contact form submissions for [period, e.g., 12 months] for customer service purposes. We do not use information submitted through contact forms for marketing purposes unless you have separately opted in.
Cookies
If you leave a comment on our site you may opt-in to saving your name, email address and website in cookies. These are for your convenience so that you do not have to fill in your details again when you leave another comment. These cookies will last for one year.
If you visit our login page, we will set a temporary cookie to determine if your browser accepts cookies. This cookie contains no personal data and is discarded when you close your browser.
When you log in, we will also set up several cookies to save your login information and your screen display choices. Login cookies last for two days, and screen options cookies last for a year. If you select “Remember Me,” your login will persist for two weeks. If you log out of your account, the login cookies will be removed.
If you edit or publish an article, an additional cookie will be saved in your browser. This cookie includes no personal data and simply indicates the post ID of the article you just edited. It expires after 1 day.

What we collect and store (store-specific)

Our team members have access to this information to help fulfill orders, process refunds and support you.
Who we share your data with
We share information with third parties who help us provide our orders and store services to you, including payment processors, shipping providers, tax-calculation services, email and marketing platforms, analytics providers, and customer support tools. If you request a password reset, your IP address will be included in the reset email.
Payments
We accept payments through PayPal. When processing payments, some of your data will be passed to PayPal, including information required to process or support the payment, such as the purchase total and billing information.

Caching (LiteSpeed Cache)
This site utilizes caching in order to facilitate a faster response time and better user experience. Caching potentially stores a duplicate copy of every web page that is on display on this site. All cache files are temporary, and are never accessed by any third party, except as necessary to obtain technical support from the cache plugin vendor. Cache files expire on a schedule set by the site administrator, but may easily be purged by the admin before their natural expiration, if necessary. Tax and shipping (WooCommerce Tax / WooCommerce Shipping)

Spam protection (Akismet)
We collect information about visitors who comment on the site using our Akismet Anti-spam service. The information collected depends on how Akismet is configured but typically includes the commenter’s IP address, user agent, referrer, and site URL, along with other information directly provided by the commenter (such as their name, username, email address, and the comment itself).
How long we retain your data
If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue.
For users that register on our website (if any), we also store the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information.
We generally store information about you for as long as we need it for the purposes for which it was collected and used, and where we are not legally required to keep it for longer.
